The CNMC is probing several companies for potential collusion in bidding for leases at Aena's airports for fixed-base operations (FBO), following inspections conducted at their premises.


The CNMC is investigating multiple companies for suspected agreements or concerted practices to divide the tenders issued by Aena for leasing facilities designated for FBO activities at airports. Inspections carried out between May 28 and 31, 2024, are part of the preliminary steps before potentially initiating formal sanctioning proceedings.

Collusion among competitors is considered a serious violation of competition law, with fines of up to 10% of the total turnover of the infringing companies. Cartel investigations are a top priority for the CNMC due to their severe impact on consumers and market functioning.

The CNMC offers a Leniency Program allowing cartel participants to benefit from fine exemptions or reductions by providing valuable evidence. Additionally, the CNMC has an online platform for anonymous reporting of anticompetitive practices, such as price-fixing agreements or bid rigging.
