The CNMC challenges local authorities in Spain for imposing unjustified restrictions on fiber optic installation, affecting operators and competition in the telecommunications sector.


The CNMC has challenged the requirements imposed by the Lekeitio City Council in Spain, prohibiting the deployment of fiber optics on facades and demanding internal or underground installation. Despite CNMC's requests to annul these requirements, the municipality granted the license without considering the Commission's concerns.

In another case, the CNMC required the justification from the Vélez-Málaga City Council for prohibiting fiber optic installation, stating that such restrictions should only apply in specific cases like buildings of cultural interest or public safety concerns.

Furthermore, the CNMC addressed issues in the postal services sector, where the Leganés City Council in Madrid was found to be favoring Correos, the designated operator, with disproportionate criteria, potentially hindering fair competition.

Additionally, the CNMC highlighted concerns in the field of education, as the Generalitat de Catalunya imposed territorial criteria for digital training subsidies, which the CNMC deemed discriminatory and in violation of certain legal provisions.
