The CNMC is investigating possible anti-competitive practices related to market allocation agreements among agricultural machinery dealers. Inspections were conducted in June 2024 at the premises of several companies operating in this market, following a previous round of inspections in September 2023.
If evidence of prohibited practices is found, the CNMC may initiate sanctioning proceedings, with fines of up to 10% of the companies' total turnover for violations of competition law. The CNMC offers a leniency program for cartels, providing benefits such as fine exemptions or reductions for companies providing valuable information.
Additionally, the CNMC has an online platform for anonymous reporting of anti-competitive practices, encouraging individuals to report activities like price-fixing agreements, market/customer allocation, or fraudulent bidding in public or private tenders.
