Education Software Solutions Ltd (ESS), the largest provider of management information systems in the UK for schools, is under investigation by the Competition and Markets Authority (CMA) for potential abuse of dominance. ESS is accused of hindering schools from switching to other providers by making data transfer complex and objecting to alternative solutions. The CMA is considering imposing interim measures to prevent harm while investigating, and if found guilty, ESS could face fines up to 10% of its turnover. This case falls under the Chapter II prohibition of the Competition Act 1998, which prohibits abuse of a dominant position in the market.
