18.03.2024 | 🇳🇱 Dutch competition authority
The Netherlands Authority for Consumers and Markets (ACM) accepted a commitment from Vion, a meat producer, to only change contracts with pig farmers with their agreement, enhancing the farmers' bargaining power. This commitment aligns with the Dutch Act on unfair trading practices, aimed at bolstering food suppliers' positions. The commitment also affects the one-year notice period for contract changes, with Vion still bound by it. POV, a pig farmers' organization, raised concerns about compensations not being addressed in the commitment, with ACM directing such claims to civil courts or Complaints Boards. The Act, effective since November 2021, aims to empower farmers against larger market players, addressing various unfair trading practices beyond contract alterations. ACM's study shows a lack of buyer awareness of the Act, prompting efforts to enhance compliance through communication and enforcement.
