International Cooperation in Sports Goods Antitrust Investigation

10.12.2024 | 🇳🇱 Dutch competition authority

The Netherlands Authority for Consumers and Markets (ACM) is aiding the Romanian Competition Council in investigating potential illegal agreements in the sports goods sector, following dawn raids at several companies.

The Netherlands Authority for Consumers and Markets (ACM) has provided assistance to the Romanian Competition Council (RCC) in an investigation concerning possible illegal agreements within the sports goods industry. This investigation has led to dawn raids at the premises of three companies, including one based in the Netherlands.

The RCC suspects that a supplier of sports goods has imposed restrictions on a distributor regarding the sale of its products to retailers. Such restrictions are generally prohibited, as suppliers should not dictate which customers their distributors serve. This principle is applicable to businesses in both Romania and the Netherlands, emphasizing the importance of free market practices.

The RCC has announced that it will continue its investigation into these allegations. This case highlights the significance of international cooperation among competition authorities, as they work together to enforce EU competition rules, including prohibitions against cartels and abuse of dominant market positions. The collaboration between ACM and RCC serves as a prime example of how national authorities can assist each other in addressing competition law violations.

For individuals who suspect illegal agreements among manufacturers, distributors, or retailers, ACM encourages them to report their findings. They can do so anonymously if preferred, ensuring that competition laws are upheld and markets remain fair.
