The Competition Council decided against launching an investigation into Go3 Baltics after complaints from industry associations and companies alleging violations of Competition Law and EU Treaty provisions.
The complaints centered around Go3 Baltics' new contract conditions, such as requiring customers to connect via the Go3 platform or app, potentially leading to customer abandonment of other service providers.
However, the Competition Council found that the number of users of Go3 programme packages was relatively small compared to the complainants' customer base, and the alleged actions did not significantly harm consumers or restrict other companies' market operations.
Due to a lack of concrete evidence and the disproportionate resources needed for a detailed investigation, the Competition Council concluded that pursuing the case would not align with principles of promoting effective competition and consumer welfare.
The decision of the Competition Council can be challenged at the Regional Administrative Court within one month of its delivery or publication on the institution's website.
