Unauthorized Services: Compensation Required for Former UPC Customers

24.09.2024 | 🇵🇱 Polish competition authority

Former UPC customers in Poland are entitled to refunds for unauthorized services as the President of the Office of Competition and Consumer Protection (UOKiK) issues a decision against the company.

Former UPC customers in Poland who were part of the 'More Benefits for You' package will receive compensation for services they did not order. The UOKiK President found that UPC Poland automatically activated additional TV channels and increased internet speed for customers without their explicit consent, resulting in higher fees.

The UOKiK President emphasized that consumer consent is essential for any paid services added to existing contracts, and lack of objection should not be interpreted as consent.

UPC Poland, now P4, will no longer charge increased fees without customer consent and will refund customers for the period they paid higher fees under the 'More Benefits for You' program. The company will also offer preferential terms for mobile internet.

Additionally, the UOKiK President raised concerns about companies automatically activating and charging for additional services without clear consumer consent, as seen in the case of Canal+ Poland.
