The President of the Polish Office of Competition and Consumer Protection (UOKiK) has initiated an investigative procedure regarding potential anti-competitive practices by the Polish Canine Association, raising concerns about its impact on members' rights and market competition.


The UOKiK has launched an investigation into the Polish Canine Association over suspicions of anti-competitive practices. The association, a prominent organization in Poland for breeders of pedigree dogs, is being scrutinized for its market dominance and restrictive actions that may limit members' rights.

One of the key concerns is the association's statute prohibiting members from participating in other canine organizations not affiliated with the Polish Canine Association or the International Cynological Federation (FCI). Such restrictions could hinder breeders from engaging in activities outside the association, potentially impacting the revenue of other organizations. Additionally, the ban on judges collaborating with the association from participating in events of non-FCI recognized associations is under review for its competitive implications.

The UOKiK is assessing whether these actions impede competition in the broader market of pedigree dog breeding organizations in Poland. The President of UOKiK emphasized the importance of breeders having the freedom to choose their affiliations and participate in various events without undue restrictions that could harm other organizations' operations.

Furthermore, the investigation highlights the legal obligations for entities, including industry associations like the Polish Canine Association, to refrain from anti-competitive practices. If found guilty, fines of up to 10% of the turnover can be imposed. Past decisions by the UOKiK in similar cases involving business associations have been upheld by the Competition and Consumer Protection Court.

The ongoing investigative procedure is aimed at examining the situation rather than targeting specific businesses. Should the collected evidence support the President's concerns, an antitrust procedure will be initiated, potentially leading to financial penalties against the implicated entities. The UOKiK encourages reporting of anti-competitive practices through an anonymous whistleblowing program to ensure transparency and compliance.
