The CNMC in Spain is responsible for ensuring that video platforms have effective age verification systems to prevent minors under 18 from accessing harmful content such as pornography and violence. A recent public consultation received 35 responses from various stakeholders in the industry.
The feedback highlighted the importance of age verification systems covering both content and related advertising to protect minors' rights. Most respondents agreed that these systems should precede access to pornographic content, regardless of the platform, and be implemented before content access.
Regarding the choice of age verification systems, the majority advocated for diverse options for platforms to choose from, catering to different user needs and business models. The market trend leans towards remote verification methods like ID document checks with a selfie or facial age estimation.
Stakeholders emphasized the significance of data protection in age verification systems, with many supporting the use of the European digital wallet (eIDAS2) for validating age without sharing additional personal data. The preference for independent third parties to conduct age verification was strong, promoting user trust and data privacy.
Furthermore, stakeholders viewed self-regulation tools positively for industry involvement, flexibility, and potential standard-setting, despite concerns about the time needed for development. The CNMC's role in overseeing these systems aligns with efforts to protect minors online.
