The UOKiK initiated antitrust proceedings against Wodociągi Zachodniopomorskie for allegedly requiring water customers to pay for repairing water supply connections outside their properties, which may constitute an abuse of dominant position.
The President of UOKiK, Tomasz Chróstny, referred to a Supreme Court ruling stating that water companies should bear the costs of repairing connections beyond the property boundaries of customers, leading to potential penalties of up to 10% of the company's annual turnover.
In 2017, the Supreme Court clarified the ownership and cost responsibility of water supply connections, emphasizing that water companies should cover the repair costs even beyond the customer's property line. The rulings established that customers are not obligated to finance repairs outside their property boundaries.
Additionally, the regulatory authority for the water and sewage market in Poland is the State Water Holding Wody Polskie, responsible for approving water tariffs, reviewing service regulations, and resolving disputes between water companies and customers.
UOKiK encourages reporting any competition-restricting practices through an anonymous whistleblowing program to gather information on anticompetitive behaviors in the market.
