The European Commission is seeking feedback on draft guidelines related to abusive exclusionary practices by dominant companies, as prohibited under Article 102 of the Treaty on the Functioning of the European Union (TFEU). The draft guidelines aim to reflect EU case law on abusive exclusionary practices by dominant companies, providing legal certainty for national competition authorities, courts, businesses, and consumers.
Feedback on the draft guidelines can be submitted by all interested parties until October 31, 2024. The guidelines are designed to offer a predictable, coherent, and practical framework for assessing abusive practices, based on the Commission's interpretation of EU case law and practical experience in applying rules against the abuse of dominance.
