In August 2021, Generalife Clinics acquired exclusive control of the fertility group Clínicas Ginemed, S.L. However, the company failed to notify the acquisition to the CNMC as required by the Competition Defense Law.
The CNMC imposed a fine of 510,000 euros on Generalife Clinics for breaching competition rules by not notifying the acquisition in advance, a practice known as 'gun jumping'.
GeneraLife only notified the operation in December 2023 after being requested by the CNMC. The Commission approved the purchase in April 2024 and initiated a sanctioning procedure in March 2024 due to the non-compliance.
During the investigation, GeneraLife acknowledged its responsibility and benefited from a 40% reduction in the fine amount by paying 510,000 euros in advance, leading to the closure of the sanctioning procedure by the CNMC.
