The Dutch Real Estate Council (ROZ) made changes to its model contracts for renting office and retail spaces, previously linking rent adjustments to the consumer price index (CPI) automatically. This practice was found to be against competition rules as it limited negotiation between parties. By removing automatic adjustments, ROZ now allows for mutual agreement on rent adjustments, providing more flexibility for lessors and lessees. The adjustments were made following discussions with ACM to ensure compliance with competition regulations. The case highlighted the importance of avoiding prohibited recommendations by trade associations that could restrict competition in the market.
