The Netherlands Authority for Consumers and Markets (ACM) has concluded that asphalt producers can collaborate to enhance sustainability in their production processes. This decision follows a request from Bouwend Nederland, a trade association representing the Dutch construction and infrastructure sector, seeking clarity on the legality of such collaboration.
The initiative focuses on transitioning to 'Warm Mix Asphalt', which is produced at lower temperatures (between 100 and 140 degrees Celsius) compared to traditional methods that can reach up to 180 degrees Celsius. This shift is expected to reduce energy consumption and lower CO2 emissions, aligning with broader environmental goals.
ACM's informal assessment found no objections to the collaboration, emphasizing that it would not compromise asphalt quality. Participation in this initiative is voluntary, allowing producers to choose their sustainability standards and production methods independently.
However, ACM cautioned that the collaboration should not result in price increases for consumers, particularly if the new asphalt is sold at significantly higher prices. Currently, ACM believes the likelihood of such price hikes is minimal.
ACM is committed to fostering a sustainable economy and encourages businesses to explore collaborative efforts that contribute to sustainability, while also providing a collaboration test to help assess compliance with competition rules.
