Austrian Cartel Court Imposes Fine on Bodner in Construction Cartel Case

The Austrian Cartel Court has fined Bodner EUR 1.05 million for participating in price-fixing and market allocation practices in the construction sector, following a request by the Federal Competition Authority.


The Austrian Cartel Court imposed a fine of EUR 1.05 million on Bodner for engaging in anticompetitive practices in the construction industry, specifically in road construction, between December 2010 and July 2015 in Tirol.

Bodner cooperated with the Federal Competition Authority outside the leniency program, providing comprehensive information and admitting to the allegations, leading to a reduced fine being requested by the authority.

The cartel involved agreements among companies to secure contracts, maintain market shares, and ensure capacity utilization, including price-fixing, market allocation, exchange of sensitive information, and forming illegal consortia.

The violations affected both public and private clients across Austria, with investigations ongoing for numerous construction projects, some of which have already concluded.
