Investigation Launched into Parfait Group's Merger Commitments in Martinique

The Autorité de la concurrence has initiated an investigation into the Parfait group's compliance with merger commitments regarding the La Batelière hypermarket in Martinique.


The General Rapporteur of the Autorité de la concurrence has confirmed that hearings and observations are underway in Martinique to verify the commitments made by the Parfait group following its acquisition of the Géant Casino La Batelière hypermarket.

In December 2022, the Autorité approved the merger on the condition that the Parfait group divest the La Batelière hypermarket to prevent a duopoly in the hypermarket sector in the Plaine Foyalaise area. The group also committed to maintaining the value of both the hypermarket and the shopping center it is located in.

As of December 2023, the Autorité has commenced proceedings to assess whether these commitments are being fulfilled. This phase involves on-site observations and hearings with relevant stakeholders in Martinique. The outcome of this investigation could lead to a determination of non-compliance with the commitments made.

The investigation does not imply any guilt on the part of the Parfait group. A thorough inter partes investigation will be necessary to ascertain whether the commitments are being met, which will include the exchange of written observations and an oral hearing.

If the Parfait group is found to be non-compliant, the Autorité has several enforcement options, including withdrawing the clearance of the merger, imposing penalties, or requiring the implementation of alternative commitments. Fines may also be levied, potentially reaching up to 5% of the entity's revenue or €1.5 million for individuals.
