New Guidance on "Free Choice of Payment Brand" in Physical Retail

02.05.2024 | 🇩🇰 Danish competition authority

The Competition and Consumer Authority in Denmark has issued guidance aimed at Visa, Nets, and Danish financial institutions regarding co-branded payment cards and ensuring free choice of payment brand in physical retail settings.

A new guidance titled 'Free Choice of Payment Brand' targets Visa, Nets, and Danish banks, following the adoption of new terms for co-branded payment cards. These cards combine different brands, such as Visa/Dankort.

The guidance specifically addresses co-branded cards in relation to mobile payment solutions like Apple Pay and Google Pay when used in physical stores.

The rules in the interbank fee regulation aim to ensure that both businesses and consumers can freely choose which payment brand to use. The regulation includes a prohibition on card schemes or licensing agreements that make it difficult or prevent a card issuer from co-branding two or more brands on one card.

The Competition and Consumer Authority acts as an independent payment authority overseeing the provisions of the interbank fee regulation regarding 'free choice'.
