CMA's Decision on Shipping Competition Exemption

08.02.2024 | 🇬🇧 UK competition authority

The Competition and Markets Authority (CMA) will not recommend the renewal of the Liner Shipping Consortia Block Exemption Regulation (CBER) due to concerns about reduced competition and lack of benefits for customers.

The CMA received feedback from shipping companies, customers, and trade bodies regarding the CBER, which provides an exemption from competition law for certain agreements between liner shipping companies. The CMA concluded that while cooperation through consortia can bring benefits, it can also reduce competition, impacting charges and service quality. The decision not to recommend a new block exemption was influenced by the need for liner shipping companies to self-assess their consortia due to market share thresholds and the requirement to comply with both EU and UK competition laws. This move will have implications for the liner shipping industry, as companies will now have to ensure compliance with competition laws without the automatic exemption previously provided by the CBER.
