The ACM has directed online store On that ass to explicitly inform consumers that ordering a 'free' pair of boxer shorts entails signing up for a paid subscription for monthly deliveries, after receiving complaints from consumers who were misled into subscriptions without clear disclosure on the website. This action followed a request for enforcement from Poland regarding similar misleading practices.
Renske Fikkers, from ACM's Consumer Department, emphasized the importance of consumers being fully aware of entering into paid subscriptions, noting that clear disclosure is essential to avoid misleading consumers. The online store has now updated its website to provide transparent information about the subscription terms.
Consumers have the right to receive comprehensive information before making a purchase, especially for subscriptions. Previously, On that ass did not clearly communicate that accepting the free boxer shorts would lead to a paid subscription with monthly deliveries. The online store has made the necessary adjustments to ensure transparency, including in online advertisements. Additionally, consumers are entitled to a 14-day cooling-off period for online purchases, even for washable products like boxer shorts.
