The Netherlands Authority for Consumers and Markets (ACM) has published draft guidelines for market participants falling under the Digital Services Act (DSA) to assist them in preparing for the new European rules. The DSA aims to create a safe and trustworthy online environment and includes obligations for online platforms, search engines, marketplaces, broadband providers, and hosting service providers. The guidelines cover topics such as dispute settlement, dealing with illegal content, protection of minors, and prevention of dark patterns. Market participants and interested parties have until February 16, 2024, to submit their opinions on the draft guidelines. The DSA will come into force in the Netherlands on February 17, 2024, and ACM will be responsible for enforcement.
