The Portuguese Competition Authority (AdC) conducted an investigation into an association of companies providing consultancy services for architectural and engineering projects in Portugal. The investigation revealed that the association had been fixing minimum prices since at least 1994, leading to the issuance of a Statement of Objections.
Upon identifying anti-competitive practices, the AdC formally informed the business association of the objections raised against it. The association has the right to a hearing and defense before a final decision is made by the AdC.
Fixing minimum prices by a business association restricts competition and harms consumers. Companies are expected to autonomously set prices and commercial conditions. Violations of competition rules not only impact consumers' welfare but also harm the competitiveness of companies and the economy.
The AdC has published a Guide for Business Associations to educate them on competition rules, behaviors to avoid, and the benefits of promoting competition.
