The French competition authority has fined SAS Distribution du Domaine d’Uby (SDU) for engaging in cartel practices by imposing a minimum resale price on its distributors of 'Uby' wines under the 'Côtes de Gascogne' protected geographical indication (PGI), along with Armagnacs.
SDU controlled its distributors' pricing freedom through recommended prices and monitoring mechanisms, including sanctions for non-compliance. The company did not contest the practices and benefited from the settlement procedure, resulting in a €500,000 fine.
The Autorité de la concurrence found that SDU's actions violated competition law by restricting distributors' pricing freedom and contractually setting resale prices. The decision highlights that suppliers cannot impose resale prices on their distributors, whether through monitoring, sanctions, or contractual agreements.
