Austrian Construction Cartel: BWB Seeks Fine Against Malaschofsky

The Austrian competition authority, BWB, has requested a fine of EUR 98,000 against Malaschofsky for participating in cartel activities related to construction projects in Lower Austria.


Malaschofsky engaged in cartel activities such as price fixing, market allocation, and information exchange with competitors in public and private construction tenders in Lower Austria from at least February 2003 to May 2017.

The cartel activities were part of a nationwide violation involving various companies, aiming to minimize competition, secure contracts, and maintain market share.

Malaschofsky cooperated with BWB outside the leniency program, leading to a reduced fine request, considering the full disclosure of information and her financial capacity.

The cartel uncovered in the construction sector affected both public and private projects across Austria, with ongoing investigations and some cases already concluded.

Collusive practices included bid rigging, market sharing, exchange of sensitive information, and the formation of anti-competitive consortia among the companies involved.
