The Danish Competition and Consumer Authority has forwarded a case to the European Commission and the Irish DSA oversight regarding fake ads featuring popular TV hosts from DR and TV 2 on Facebook and Instagram. Initial investigations suggest a possible breach of the EU Digital Services Act.
The fake ads on Facebook and Instagram use well-known TV hosts to attract attention and lure users to click on links to websites recommending investments in cryptocurrencies. However, the TV hosts have no affiliation with these websites and have not consented to participate in the ads.
The EU Digital Services Act mandates platforms like Facebook and Instagram to promptly and carefully handle all reports of illegal content and mitigate systemic risks on their platforms, including the spread of unlawful content.
The Danish DSA oversight has been in communication with the European Commission and agreed to transfer the cases and relevant materials. They will assist in further proceedings if the European Commission and the Irish DSA oversight decide to pursue the matter.
The Danish Competition and Consumer Authority is responsible for overseeing digital intermediation services based in Denmark to ensure compliance with the DSA. While they cannot address complaints about platforms established in other EU countries, they can refer complaints to the relevant DSA oversight. Additionally, they can initiate cases involving both Danish and foreign platforms.
