The CNMC sanctioned Atresmedia for broadcasting covert advertising of an alcoholic beverage during the show 'El Hormiguero'. The program displayed images and mentioned a 36-degree alcoholic drink outside the permitted advertising hours, without disclosing it was an ad, potentially misleading viewers.
This action violated the General Law of Audiovisual Communication, specifically articles prohibiting covert advertising and regulating advertising that promotes harmful health behaviors, such as alcoholic beverages above 20 degrees, except between 1:00 and 5:00 am.
Atresmedia received two fines totaling 579,374 euros, reduced by 40% for admitting responsibility (20%) and early payment (20%).
