Employees of the Polish Office of Competition and Consumer Protection (UOKiK) raided the premises of ABB Polska, a technological company, and its distributors based on allegations of anticompetitive practices.
It is suspected that ABB Polska and its distributors may have engaged in market allocation, price fixing, and sharing sensitive information, prompting the President of UOKiK to initiate an investigative procedure. The searches were conducted with court approval and police assistance at the locations of ABB Polska and five distributors.
The investigation is not targeted at specific businesses yet, but if evidence confirms the suspicions, the UOKiK President will commence antitrust proceedings and bring charges against the relevant entities, potentially leading to financial penalties of up to 10% of the company's turnover.
Businesses and managers involved in anticompetitive practices could benefit from leniency programs, offering the chance to reduce or avoid monetary sanctions by cooperating as 'crown witnesses' with UOKiK and providing evidence of illegal agreements. The UOKiK encourages those interested in leniency to contact the office for further information.
Additionally, UOKiK operates a program for gathering information from anonymous whistleblowers to report anticompetitive behaviors, ensuring complete anonymity for the informants.
