Competition Authority Declines Investigation into Health Insurance Market

The Competition Authority has decided not to initiate an investigation into potential competition violations in the mandatory health insurance market, while continuing to monitor the situation.


The Competition Authority received two requests to initiate oversight proceedings regarding possible competition violations in the mandatory health insurance market for healthcare providers. On October 23, 2024, a request was made concerning Vanden Kindlustusmaaklerid AS, alleging potentially harmful information exchange affecting competition. The authority reviewed the circumstances presented but decided against starting an investigation.

Additionally, on October 7, a complaint was filed regarding PZU, the sole provider of mandatory health insurance for healthcare services, claiming that their insurance premiums are excessively high. However, the Competition Authority deemed it premature to conclude that PZU holds a dominant market position, noting that this situation has only recently developed and is influenced by preparatory activities prior to the enactment of the mandatory health insurance law.

The authority is aware that there are no barriers preventing other insurance companies from entering the market, and it does not rule out the possibility of new entrants once sufficient practice and statistical data become available. Kadri Lepikult, head of the competition administrative procedure department, stated that they will continue to monitor the market and hope that after the law's implementation, data availability and transparency will improve, making the market more attractive for other insurers and enhancing competition in the future.

Currently, the Competition Authority does not find it justified to conduct a detailed analysis of the competitive situation, as the preparation of the mandatory health insurance law included impact assessments and the establishment of suitable conditions for service provision. The Social Ministry is the competent authority for issues related to the implementation of the mandatory health insurance law.
