The European Competition Network (ECN) has positively assessed the European Commission's draft guidelines on the abusive exclusionary practices of dominant companies under Article 102 of the Treaty on the Functioning of the European Union (TFEU).
The ECN's joint report highlights its active contribution to the development of the guidelines, emphasizing that they represent a significant step towards a practical approach to implementing Article 102 of the TFEU.
Article 102 of the TFEU prohibits dominant companies from engaging in abusive practices that exclude competitors from the market, such as predatory pricing, exclusive dealing, and refusal to supply.
Effective enforcement of Article 102 is crucial to ensure competitive markets, fair competition for all companies, and benefits for consumers from competitive markets.
The Competition Council reminds stakeholders to provide feedback on the draft guidelines on abusive exclusionary practices by dominant companies issued by the European Commission.
The aim of the guidelines is to provide a predictable, coherent, and practical framework for assessing abusive conduct, reflecting the Commission's interpretation of EU case law and valuable experience in applying the prohibition of abuse of dominance.
Interested parties can submit feedback on the guidelines until October 31, 2024.
