The Italian Competition Authority imposed a EUR 10 million fine on two Amazon group companies for unfairly pre-selecting the 'recurring purchase' option for a wide range of products on the Amazon.it marketplace, restricting consumer choice.
This practice was found to limit consumers' freedom to choose and may lead to unnecessary purchases, contrary to professional diligence standards. Amazon, as a major player, is expected to design its online interfaces to enable consumers to make informed decisions.
Additionally, the Authority accepted commitments from Amazon to only pre-select the free delivery option in the future, following a challenge to the pre-selection of a paid fast delivery option. The company will also compensate consumers who complained about this practice to Customer Service in 2023.
