The Netherlands Authority for Consumers and Markets (ACM) conducted its annual fall check, requesting financial data from energy suppliers. The results indicate that, on average, these suppliers are in a stronger financial position compared to several years ago. Most suppliers are also compliant with regulations regarding the timely issuance of annual and final bills to customers.
Despite the overall improvement, ACM identified that several suppliers need to enhance their energy-buying strategies. Many have entered into fixed-price contracts with households and small businesses but have not secured enough energy in advance, leaving them vulnerable to market price fluctuations.
Currently, 52 suppliers hold licenses for electricity supply, while 50 are licensed for natural gas. ACM's Board Member, Manon Leijten, noted that while financial health has improved since the tightening of regulations in October 2022, some suppliers still fail to meet financial, administrative, and energy-buying requirements. These suppliers are now under increased scrutiny and must submit improvement plans.
ACM's analysis shows that suppliers with higher market shares have seen better improvements in their solvency compared to those with smaller shares. The authority is also conducting stress tests to ensure suppliers can withstand market downturns and have credible contingency plans.
Recently, ACM revoked the licenses of two suppliers, while five others voluntarily returned theirs. Several suppliers remain under heightened oversight due to concerns about their administrative quality, risk management, financial stability, and energy-buying strategies.
In terms of licensing, the number of licensed suppliers has slightly decreased, but interest in obtaining licenses has risen in 2024. ACM has engaged in discussions with five potential new suppliers, emphasizing the importance of understanding the legal requirements associated with licensing. This year, two businesses were granted licenses, while three applications were rejected or halted due to non-compliance with the necessary standards.
