UOKiK Initiates Proceedings Against Payment Delays

19.08.2024 | 🇵🇱 Polish competition authority

The President of the Polish Office of Competition and Consumer Protection (UOKiK) has launched 10 proceedings against companies failing to pay their suppliers on time, with a focus on the impact on small and medium-sized enterprises.

The President of UOKiK, Tomasz Chróstny, has initiated 10 proceedings against companies that have delayed payments to their suppliers, causing particular harm to micro, small, and medium-sized businesses relying on current capital to meet their obligations.

Before commencing these proceedings, UOKiK first issued 'soft interventions' to signal payment issues and recommend immediate improvements in payment practices to the companies involved.

The penalties for businesses found guilty of excessive delays in meeting monetary obligations will be determined based on the amended 2022 law on combating excessive delays in payments, considering the value of overdue payments, the length of delays, the severity of the violation, actions taken by the business to rectify the situation, and cooperation with the Authority during the proceedings.

For more information on UOKiK's competencies regarding payment delays, including what constitutes payment delays, when the President of the Office can intervene, how to report non-compliant businesses, and who can do so, visit the dedicated webpage on https://uokik.gov.pl/zatory-platnicze.
