The Ministry of Interior in Spain is working on a regulation for safe and efficient driving courses that would allow drivers who pass the courses to earn two points on their licenses. However, certain requirements in the proposed regulation could lead to increased costs for smaller operators, particularly in rural areas, and reduce competition. The regulation aims to standardize the content and structure of the courses and establish administrative procedures for interested entities. The National Commission on Markets and Competition (CNMC) has analyzed the proposed regulation and has made recommendations to address potential issues related to costs, competition, and flexibility in course delivery. The CNMC suggests allowing certification for multiple courses through a single process, permitting joint training for students in different courses, and allowing online or hybrid delivery of the theoretical portion of the courses. The CNMC also recommends reevaluating strict limits on student-to-instructor ratios and justifying any restrictions on students providing their own vehicles for certain courses. Additionally, the CNMC suggests providing detailed information on insurance requirements for the entities offering the courses. The CNMC notes that the requirements for becoming a driving instructor appear to be more complex and demanding than those for becoming a driving school teacher, and recommends evaluating these requirements under the test of proportionality for regulated professions.
