Antitrust Investigation on Labor Market Collusion in Poland

08.07.2024 | 🇵🇱 Polish competition authority

The Polish competition authority is investigating suspicions of illegal agreements between retail chains and transport companies not to poach each other's drivers, potentially leading to restricted job mobility and wage growth for drivers.

The President of the Polish Office of Competition and Consumer Protection (UOKiK) has initiated an investigation into the labor market practices of retail chains Biedronka and Dino, as well as transport companies serving them. This follows suspicions of agreements that hindered competition for workers, potentially coordinated by the retail chains, leading to restricted job mobility and wage growth for drivers.

If confirmed, the companies involved could face antitrust proceedings, with fines of up to 10% of their turnover. The practice of 'no-poaching agreements' can harm competition by affecting the wages offered to workers, potentially resulting in lower salaries or limited wage growth.

The UOKiK has prepared a guide explaining the illegality of competition-restricting agreements in the labor market, emphasizing the negative impact on workers and economic development. The guide is recommended for employees, HR departments, and businesses of all sizes.
