The e-commerce platform Temu, one of the largest shopping platforms with Chinese capital, operates in Poland through an Irish company, Whaleco Technology Limited. The President of UOKiK has raised concerns about the lack of clarity regarding the division of responsibilities between Temu and the sellers, as well as the ambiguity of whether consumers are entering into agreements with businesses or individuals.
UOKiK's investigation focused on the presentation of crucial information for buyers on the Temu website and app, highlighting the importance of online platforms providing consumers with required legal information before making a purchase.
The President of UOKiK also criticized the unclear presentation of seller information on Temu, noting that accessing such details may require multiple clicks and could sometimes be in Chinese. Transparency and clear information provision to consumers during online shopping are essential, especially in light of the increased digital protection under the Omnibus Directive.
Another issue raised by UOKiK concerns the labeling of the order button on Temu, suggesting that the current wording may not clearly indicate the obligation to pay for the products in the virtual cart, as required by law.
If the allegations are confirmed, Whaleco Technology Limited could face fines of up to 10% of its turnover for each disputed practice. UOKiK is also conducting an explanatory procedure regarding Temu's pricing presentation and other consumer-related information.
