CNMC Takes Action Against Discriminatory Practices in Andalusian Health Service and Madrid Municipality

The CNMC requires the Andalusian Health Service to stop discriminating against brand-name drugs in pharmacies and demands that the Madrid Municipality stops discriminating in the distribution of subsidies for private vehicle renewal.


The CNMC has requested the Andalusian Health Service to revoke an agreement prioritizing the sale of generic drugs over brand-name drugs in pharmacies, citing a violation of the non-discrimination principle of the Law on Market Unity Guarantee.

In a separate case, the CNMC has intervened with the Madrid Municipality, objecting to a requirement that vehicles must be purchased within the Madrid region to qualify for environmental subsidies, deeming it territorially discriminatory.

Additionally, the CNMC has addressed issues related to the rejection of fiber optic installations in Torrelavega and Algeciras, as well as restrictions on photovoltaic and wind installations in Ejea de los Caballeros, emphasizing reasons of general interest.

Furthermore, the CNMC has commented on the withdrawal of a kiosk license in Madrid due to the owner not actively selling, suggesting that while there may be a legitimate public interest basis, it should be properly justified in the regulatory ordinance.
