The High Court has denied Nicholas Brown's request to remain as a director after he was disqualified for his involvement in an illegal cartel.


The High Court has rejected Nicholas Brown's application to continue acting as a director of Brown and Mason Limited and NRLB Limited after he was disqualified for his role in an illegal cartel. The Competition and Markets Authority (CMA) fined 10 construction firms for colluding to rig bids for demolition and asbestos removal contracts. Brown admitted to being personally involved in two breaches of competition law and accepting compensation payments. The Court agreed with the CMA that granting an exemption from Brown's disqualification would not be appropriate due to the seriousness of his behavior. The decision highlights the importance of director disqualification as a deterrent and protection for the public. Brown will be allowed to remain in his current position until July 2024, after which he will be prohibited from acting as a director until July 2030.
