The UOKiK President penalized LoanMe for not returning due costs to consumers who repaid loans early and for misleading them about their rights. LoanMe also engaged in the practice of refinancing loans, resulting in consumers incurring very high non-interest costs.
According to UOKiK, LoanMe provided loans, mostly in amounts of several thousand Polish zlotys, and was reported for irregularities in settlements for early repayments. Consumers also complained about the company's loan refinancing mechanism, which led to high non-interest costs and significant debt accumulation.
LoanMe refused to reimburse consumers who repaid loans early before the September 2019 ruling by the Court of Justice of the European Union (CJEU), falsely claiming that there was no legal obligation to do so before that date. This could have influenced consumers' decisions to forgo their rightful claims.
LoanMe's practice of alternating loan refinancing with another company without the consumer's explicit request led to excessively high non-interest costs, pushing consumers into a debt spiral. The UOKiK President imposed a fine of over 550,000 Polish zlotys on LoanMe for these practices.
Consumers have the right to a proportional refund of all loan costs if they repay a consumer loan early, as confirmed by the CJEU ruling in September 2019. LoanMe's actions violated consumer rights and misled them about their entitlements, resulting in the imposition of a significant fine.
