Austrian Construction Companies Fined for Cartel Involvement

04.09.2024 | 🇦🇹 Austrian competition authority

Austrian construction company Leyrer + Graf was fined EUR 5.8 million by the Cartel Court following an application by the Federal Competition Authority for participating in cartel activities related to public and private construction tenders.

The Federal Competition Authority requested a fine of EUR 5.8 million against Leyrer + Graf for engaging in cartel activities such as price agreements, market allocations, and information exchanges with competitors in the construction sector from at least January 2007 to May 2017.

Leyrer + Graf cooperated outside the leniency program, providing comprehensive information to the authorities, leading to a reduced fine. The cartel activities affected construction tenders in several Austrian regions.

The cartel involved agreements among companies to secure contracts, market shares, and capacity utilization. Practices included price fixing, market allocations, sharing sensitive information, and forming anti-competitive consortia.
