Advocate General Kokott has proposed that the Court of Justice uphold the €2.4 billion fine imposed on Google for favoring its own comparison shopping service in search results. The Commission found that Google leveraged its dominant position in the market for general search services to give preference to its own service, resulting in an unfair advantage over competing services. The General Court confirmed the fine, but did not find evidence of anticompetitive effects on the market for general search services. Google and Alphabet have appealed the decision to the Court of Justice, and the Advocate General's opinion recommends dismissing the appeal and confirming the fine. The self-preferencing by Google is considered an independent form of abuse, and the strict criteria for recognizing abuse through the refusal of access to an 'essential facility' do not apply. The Court of Justice will now deliberate on the case and deliver its judgment at a later date.
