The Italian Competition Authority (AGCM) and the Anti-corruption Authority (ANAC) have renewed their Memorandum of Understanding to improve measures against corruption in the public administration. The agreement aims to enhance efficiency and effectiveness in combating corruption.
Under the new Memorandum, AGCM will inform ANAC of any suspected alterations in tender rules that suggest collusion between firms in public procurements. ANAC will reciprocate by reporting any collusion it uncovers to AGCM, while respecting ongoing judicial investigations.
AGCM and ANAC will collaborate to exercise their powers in public procurement and local public services management. ANAC will work with AGCM to identify competition issues in public tenders and increase reports on potential collusion. They will exchange information through the National Data Platform and may conduct diagnostic test models to detect suspected collusion.
Both authorities will cooperate in applying the Legality Rating regulation, encouraging its use and handling whistle-blower reports. They will also work together on digitalization processes, sharing technologies for processing open data and implementing analytics to maximize data utilization.
