Finnish Market Court Rejects Penalty Proposal in HVAC Infrastructure Pipeline Market Case

The Market Court in Finland rejected a proposal by the competition authority to impose penalty payments on several companies for prohibited cooperation in the HVAC infrastructure pipeline market.


In September 2022, the Finnish Competition and Consumer Authority (FCCA) recommended penalty payments totaling EUR 44 million on companies like Onninen, Dahl Suomi, Ahlsell, Uponor Infra, Uponor Suomi, and Pipelife Finland for engaging in prohibited cooperation. However, the Market Court found the evidence provided by the FCCA to be insufficient and dismissed the proposal for penalty payments.

The FCCA's proposal alleged that major manufacturers and wholesalers of plastic HVAC infrastructure pipeline products in Finland collaborated to maintain their market positions and restrict price competition between 2009 and 2016. While Pipelife and Uponor Infra were cleared of violating competition law, the Market Court determined that other companies like Onninen, Dahl Suomi, Ahlsell, and Uponor Suomi engaged in anti-competitive behavior to hinder their competitors, breaching the Competition Act.

Despite the Market Court's ruling that some companies violated competition law, it did not impose penalties as it considered the case to be a temporary and isolated incident, differing from the FCCA's assessment. The decision of the Market Court is not final and can be appealed.
