UOKiK Investigates Xiaomi for Potential Anticompetitive Practices

28.05.2024 | 🇵🇱 Polish competition authority

The President of the Polish Office of Competition and Consumer Protection (UOKiK) has initiated an explanatory proceeding regarding possible anticompetitive practices in the sale of Xiaomi hardware, with searches conducted at three entities' premises.

The President of UOKiK, Tomasz Chróstny, received information suggesting that prices of Xiaomi products may be fixed through an unlawful agreement, leading to a suspicion of illegal price-fixing in the sale of consumer electronics, home appliances, and smart products.

The investigation is not targeting specific businesses yet, but if suspicions are confirmed, the UOKiK President will commence antimonopoly proceedings and bring charges against the relevant entities, with potential fines of up to 10% of the company's turnover for participation in anticompetitive agreements.

Businesses and managers involved have the opportunity to mitigate or avoid fines through a leniency program by cooperating with UOKiK as a 'crown witness' and providing evidence of the unlawful agreement's existence.
