Deutsche Bahn AG (DB) has finalized agreements with mobility platforms to grant access to real-time data, including information on delays, train cancellations, and departure platforms, as required by the Bundeskartellamt's ruling on abusive practices.
The Bundeskartellamt found DB in violation of competition law for abusing its market power in relation to mobility platforms in June 2023. DB appealed the decision, but the DĂĽsseldorf Higher Regional Court rejected large parts of DB's request in March 2024, with the main proceeding ongoing.
Andreas Mundt, President of the Bundeskartellamt, highlighted the improvements for innovative mobility services in Germany due to the ruling. Access to real-time data allows mobility platforms to offer passengers live information on delays, recommend alternative itineraries, and facilitate multimodal journeys.
Consumers can now compare and book various transport options through online platforms, enabling multimodal journeys that combine different means of transport. This integration of public and private transport options enhances the overall travel experience for passengers.
The implementation of the Bundeskartellamt's ruling against DB is nearing completion with the provision of real-time data. While the new EU rail passenger rights regulation mandates data sharing by DB, the Bundeskartellamt emphasizes the need for additional measures to address commercial and technical aspects of data access.
DB has already removed other competition restraints identified by the Bundeskartellamt in agreements with mobility platforms, such as advertising bans. The company now pays intermediary commissions to platforms for ticket sales and booking processes, with the Bundeskartellamt setting framework conditions to ensure compliance with competition law.
