Advocate General Medina proposes that the Court dismiss the Commission's appeal against the General Court's judgment relating to Intel's alleged abuse of its dominant position on the x86 central processing units market.


The Advocate General's Opinion in Case C-240/22 P focuses on the Commission's appeal against the General Court's judgment on Intel's abuse of its dominant position. The Commission alleges errors of law and infringement of its right of defense in relation to the examination of the as-efficient-competitor (AEC) test with regard to Hewlett-Packard Company (HP) and Lenovo Group Ltd (Lenovo). The Advocate General proposes that the Court dismiss the Commission's appeal on these grounds. The case also involves the assessment of non-cash advantages granted by Intel to Lenovo. The Advocate General finds that the General Court did not commit any error in its assessment. The Court's judgment will be given at a later date.
