The Spanish competition authority is investigating Apple for potentially imposing unfair commercial conditions on developers using the Apple App Store for app distribution.


The Spanish competition authority, CNMC, is investigating Apple Distribution International Ltd. and Apple INC. for alleged anticompetitive practices related to the distribution of apps through the Apple App Store. Apple may be imposing unfair commercial conditions on developers using its app store to reach Apple users, potentially constituting an abuse of dominance under competition laws.

The investigation was initiated by CNMC due to the growing economic significance of app store activities in Spain. If confirmed, these practices could lead to severe fines of up to 10% of the companies' global turnover in the previous financial year.

The initiation of the investigation does not prejudge the final outcome, and there is a maximum period of 24 months for the CNMC to conduct the inquiry and reach a resolution.
