Six car rental companies in Italy have been fined a total of more than EUR 18 million by the Italian Antitrust Authority for including unfair clauses in their contracts. These clauses required customers to pay a lump sum fee for managing fines and unpaid parking or toll fees.
The Authority found that the additional fees charged by the companies were unjustified, as the companies only needed to transfer customers' identification data to the relevant agency handling the fines. The automatic charging of these fees to customers' credit cards without proper justification was also deemed unfair.
As a result of the fines and new sanctioning powers granted to the Authority, the companies are required to remove these clauses from their contract forms and publish an extract of the Authority's decision on their corporate websites.
