Hugo Boss Fined for Illegal Information Exchange with Competitors

16.09.2024 | 🇩🇰 Danish competition authority

Hugo Boss and two executives pay fines for unlawfully sharing information with competitors, impacting consumer prices and sales strategies.

Hugo Boss and two executives have agreed to pay fines totaling 12 million Danish kroner for violating competition law by exchanging information, including prices, with competitors who also sold Hugo Boss products. This exchange allowed the retailers to coordinate sales strategies, potentially leading to higher prices for consumers.

The illegal information exchange took place between Hugo Boss and retailers Kaufmann and Ginsborg, who were both selling Hugo Boss products while competing with the brand in the consumer market. Details shared included pricing, discounts, and sales volumes.

The violations occurred over several periods, with Hugo Boss and Kaufmann exchanging information from January 2014 to November 2017, and Hugo Boss and Ginsborg from December 2014 to April 2018. The fines imposed took into account the seriousness of the breaches, their duration, and the company's revenue, with Hugo Boss Nordic's cooperation being considered a mitigating factor.

Previously, Kaufmann had paid a fine of 6 million Danish kroner in the same case. The legal proceedings were handled by the National Unit for Special Crime due to the timing of the case, which occurred before the 2021 amendment that shifted corporate fines to civil penalties.
