Advocate General proposes upholding €2.4 billion fine on Google for favoring its own comparison shopping service

10.01.2024 | 🇪🇺 Court of Justice of the EU

Advocate General Kokott recommends that the Court of Justice uphold the €2.4 billion fine imposed on Google for abusing its dominant position by favoring its own comparison shopping service.

Advocate General Kokott has issued an opinion in the case C-48/22 P, recommending that the Court of Justice uphold the €2.4 billion fine imposed on Google for abusing its dominant position by favoring its own comparison shopping service. The Commission found that Google had given preference to its own comparison shopping service over competing services on its general search results page, resulting in a diversion of data traffic and potential anticompetitive effects. The General Court confirmed the fine, but did not find anticompetitive effects on the market for general search services. The Advocate General's opinion supports the Commission's findings and recommends dismissing Google's appeal.
