UOKiK Orders Dell to Change Practices and Imposes Fine for Misleading Information

The Polish competition authority, UOKiK, has instructed Dell to alter its sales practices in the IT sector to address concerns of potential competition law violations, while also imposing a fine for misleading conduct during the investigation.


The President of UOKiK, Tomasz Chróstny, found that Dell's sales practices in the IT sector may have restricted competition. As a result, Dell has been ordered to change its sales model to eliminate practices that could have led to market division and deprived businesses and institutions of the opportunity to purchase Dell products under more favorable conditions.

The investigation focused on suspicions of Dell entering into anti-competitive agreements with wholesale distributors and authorized sellers, particularly concerning the sale of IT infrastructure products to businesses and institutions, including through public procurement. The concerns revolved around the allocation of transactions to specific sellers, potentially hindering competitive pricing offers to customers.

UOKiK's decision requires Dell to revamp its sales system, allowing multiple authorized sellers to compete for the same transaction without Dell's approval, and introducing transparent criteria for granting discounts to sellers based on factors like transaction order and value. This aims to enhance competition and offer customers a wider range of options.
